This is the Privacy Policy of Lakunakai Incorporated (referred to as "us", "we", or "our"). This Policy describes our personal information handling practices. We take privacy and confidentiality very seriously and we safeguard the personal information of our customers in accordance with this Policy.
In this Policy, the term "personal information" means information about an identifiable individual and excludes business contact information. The term “you” means any person who may use our services.
1. CONSENT
If you use our App (the "App") or our website (our "Site") and you supply personal information to us, you:
(a) consent to the collection, use and disclosure of your personal information for the purpose of providing products and services to you;
(b) consent to receiving email and other commercial electronic messages from us for the purposes of providing products and services to you;
(c) agree to keep us informed of the correct and current personal information that you supply us.
2. COLLECTION & USE
We only collect the personal information that you supply to us.
While the App provides information, games, and educational content related to mental and physical health and wellbeing, the App is not designed to collect your personal health information, and we discourage you from inputting or disclosing any personal health information to us.
We use personal information for the purpose of providing products and services to you, in accordance with:
(a) this Policy;
(b) any other agreement you may have entered into with us; and
(c) applicable laws and regulations.
We do not sell or otherwise distribute personal information to external third parties except with your consent or as may be permitted in accordance with this Policy.
3. SHARING PERSONAL INFORMATION
We do not share or disclose any of your personal information except with your consent or in accordance with this Policy or applicable law.
We do not share your personal information with external heath care providers, therapy providers or others in the medical or mental health community. You must choose whether to disclose and how much personal information to disclose to any external heath care providers, therapy providers, or others in the medical or mental health community, and if you choose to do so, their privacy policies and professional obligations will apply to the handling of that information.
If members of the same family have access to the same account, then the members who have been granted access on the same account may have access to the content or information of other members on that account.
We may outsource certain aspects of order fulfillment, product delivery, and payment processing. For example, if you choose to purchase a product from us, our PCI-compliant suppliers will use payment information to process your payment, and our order fulfillment providers will ship the product to the address that you supply to us. We have agreements with these suppliers to maintain confidentiality, and not to retain, share, store or use personal information for any secondary purposes.
We make use of affiliate marketing technology and services and in doing so, the affiliate marketing partners access certain pseudonymous personal information that is not directly linked to a specific user, and this pseudonymous information cannot identify an individual without the use of additional information. For example, affiliate marketing partners may use cookies IDs, browsing activity, or other metadata, in order to provide the affiliate marketing technology and services, but they do not collect your name or phone number.
4. OPT-IN
At the point where we ask for the information, our customers are given the opportunity to "opt-in" to register to receive additional information from us, for any purposes not directly related to our services (such as promotions and newsletters). We only add users to our marketing lists when they expressly agree to be added. We will remove your name from our marketing lists if you unsubscribe through the mechanism provided for this purpose.
5. PRODUCT IMPROVEMENT
We may use user information in a statistical, aggregated and anonymized format, for product improvement purposes, research purposes, and to understand customer preferences such as tracking webpage usage and product interest on an aggregate basis.
6. COOKIES & LOG FILES
We may use cookies to analyze aggregated web traffic, identify whether users are signed in to our App or Site, store information about user preferences, and to recognize users when they return to our Site. If you reject cookies, you may still use our Site, though some areas may be functionally limited.
Our site servers also generate standard traffic log files. We use these files to prepare aggregate traffic statistics for our site. There is no personal information in these log files.
7. APPLICABLE LAW
We apply Canadian federal and provincial privacy law to our information handling practices. In the event of any dispute arising under this Policy, you agree to submit to the jurisdiction of the courts in the Province of Alberta, Canada.
8. A NOTE TO CALIFORNIA RESIDENTS
The California Consumer Privacy Act of 2018 (CCPA) provides California residents with specific rights regarding their personal information:
(a) You have the right to request access to your personal information that we collect, use, sell or disclosure to third parties.
(b) You have the right to request the deletion of your personal information that we collect about you and you have the right to opt-out of selling of your personal information to the third parties.
9. A NOTE TO EU AND UK CITIZENS
We endeavour to comply with the rights given to EU and UK Citizens under the General Data Protection Regulation (GDPR). These rights are as follows:
(a) Correcting your Information - the right to have your personal information updated to ensure it is up-to-date and accurate.
(b) Withdrawing Consent - the right to withdraw your consent to any processing that is currently being done under your consent, e.g. marketing.
(c) Obtaining a copy of your Information - the right to receive a copy of the personal information we hold about you.
(d) Deleting your information - right to request that we delete personal information in certain circumstances.
(e) Data Portability - the right to have us transfer to another controller the personal information that you have provided us with.
(f) Restricting Processing - the right to request a restriction on the processing of your data in some limited circumstances.
(g) Right to object to processing - right to request that we stop processing your data for marketing purposes and in other limited circumstances such as asking us not to process your data by wholly automated means or not to analyse your information for targeted content etc. (also known as profiling).
If you have a concern about how we are handling your personal information, please get in contact with us first so we can try to resolve your concern. If however you feel we have not dealt with your concern and that we are failing to meet our legal obligations, you can report this to your local data protection
regulator.
10. CHANGES TO POLICY
We may make changes to this Policy to keep it up to date. If we make changes, the revised Policy will be posted online and the date of the newest version will be listed. Please check back frequently, especially before you provide us with personal information, to determine the current scope of the Policy. If you use our Site after posting of the revised Policy, then you will be bound by the latest Policy in effect at that time.
